New Digital Time Tracking Law
The regulation reinforcing Royal Decree-Law 8/2019 (Real Decreto-ley 8/2019) will eliminate paper and spreadsheet records, requiring secure and tamper-proof digital systems for all companies.
What changes with the new regulation?
Elimination of paper and spreadsheet records
Manual records or spreadsheets will no longer be valid, except in very specific cases. All companies must implement a digital time tracking system.
Reliable and secure digital systems
Systems must guarantee tamper-proofing, traceability, security, and real-time remote access for the Labor Inspection Authority (Inspeccion de Trabajo).
Data retention for 4 years
Records must be kept for a minimum of 4 years and be immediately available for the Labor Inspection Authority (Inspeccion de Trabajo).
Personal data protection
Biometric systems such as fingerprint or facial recognition are prohibited or heavily restricted to protect employees' personal data.
